My business is small, does Health and Safety legislation apply to me? Health and safety legislation applies to organisations of any size (yes, even a headcount of one!) It covers every industry and all employers have a responsibility to protect their employees and non-employees.
Do I need to have somebody managing health and safety? Yes. Under Regulation 7 of the Management Regulations, “every employer shall, subject to paragraphs (6) and (7), appoint one or more competent persons.” You can employ your own competent person but most companies find that it is more cost effective to outsource to consultants like us.
What could happen if I am found to be breaching Health and Safety law? There are a number of possible consequences, depending on the circumstances but the potential risk of being put out of business is real. The HSE penalties range from an enforcement notice (stop the activity) to large fines (average £150,000) and even imprisonment. You will also be charged a "Fee for Intervention" which is currently £163 per hour that an HSE inspector has spent working to identify the breach and put things right.
